Terms and Conditions

1. Definitions

Kendamax - is the trade name of SC DING COMMUNICATION SRL, having its registered office in Dolj, Dobridor village, Grefierului Street, no. 2, with serial number in the Trade Register J16/700/2010, unique tax registration code RO27078460.

Seller - Kendamax

Site - the online store whose web address is www.kendama-x.ro and its subdomains.

Buyer - any natural person over 16 years of age or legal person or any legal entity who creates an Account on the Site and places an Order.

Customer - any natural person over 16 years of age or legal entity who has or obtains access to Content through any means made available by Kendamax or under a user agreement and which requires the creation and use of an Account.

User - any natural person over 16 years of age or legal entity registered on the Site, who, by completing the Account creation process, has agreed to the site-specific clauses in the Terms and Conditions section.

Account - the page on the Site consisting of an email address and a password that allows the Buyer to submit the Order and which contains information about the Buyer and his history on the Site (orders, tax invoices, etc.).

Order - electronic document through which the Buyer transmits to the Seller his intention to purchase Goods from the Site.

Goods - any product listed on the Site, to be supplied by the Seller to the Buyer.

Campaign - exposure of a finite number of Goods with limited stock, for a period determined by the Seller.

Contract - distance contract between Seller and Buyer, without simultaneous physical presence.

2. Contractual Documents

By registering an Order on the Site, the Buyer agrees to the form of communication (telephone or email) through which the Seller conducts its commercial operations.

The notification received after placing the Order is for information purposes only and does not represent acceptance of the Order.

Kendamax reserves the right to modify the quantity of Goods in the Order, notifying the Buyer and returning the amount paid, if applicable.

3. Online Sales Policy

Access to place an Order is allowed to Users/Buyers who create an Account.

Kendamax reserves the right to restrict a User's access if their actions may harm the Seller.

All prices displayed on the Site are expressed in RON and include VAT.

4. Intellectual Property Rights

The content of the Site (logos, images, texts, multimedia, etc.) is the exclusive property of Kendamax. Copying, distribution or modification without written consent is prohibited.

5. Order

The Customer/Buyer can place Orders by adding the Goods to the shopping cart and completing the payment.

The buyer confirms that the data provided is correct.

The Seller may cancel the Order if the transaction is invalidated or the data is incomplete/incorrect.

The buyer has the right to return within 14 calendar days, according to GEO no. 34/2014. The products must be returned in the same condition. The money is refunded within 14 days to the indicated account.

6. Confidentiality

Kendamax will maintain the confidentiality of the information provided. By submitting materials, you grant the Seller the right to use them according to the law.

7. Commercial Communications

Options regarding commercial communications can be modified by:

  • Account Settings in the "Newsletter" section
  • Unsubscribe link in received messages
  • Contacting Kendamax directly

8. Delivery of Goods

Delivery conditions can be found in the "Order Delivery" section on the Site.

9. Liability

By creating and using the Account, the User/Buyer is responsible for the confidentiality of the access data and accepts the updated Terms and Conditions.

10. Use of Cookies

The Cookies Policy can be found in the "Cookies Policy" section of the Site.

11. Force Majeure

Neither party is liable for failure to perform its obligations if it is caused by a force majeure event. If it lasts more than 15 days, the contract may be terminated.

12. Jurisdiction

The contract is subject to Romanian law. Disputes shall be resolved amicably or by the competent courts in the Municipality of Bucharest.

13. Return Policy

  • Buyer notifies Kendamax for return.
  • Kendamax sends the courier to pick up the products.
  • Products must be in the same condition and with all accessories/gifts included.
  • If the products are compliant, the money will be refunded, excluding the return shipping fee.
